Rhode Island Supreme Court Holds UIM Statute Runs from the Date of Breach

The Rhode Island Supreme Court has held that the statute of limitations in underinsured motorist (UIM) cases runs from the date the insurer breaches the UIM contract .  The Court strikes down insurance contract provision tying a UIM claim to the date of the underlying crash that gave rise to the claim.  Leone prepared Amicus Curiae briefs for the Rhode Island Association for Justice supporting the prevailing argument on behalf of the injured person.
